During the visa process, the applicant’s child was not included in the application. However, the Department requested the child to undertake a medical examination — otherwise, the visa could have been refused under Public Interest Criterion (PIC) 4007.
Since the applicant did not have custody rights and was unable to arrange the child’s medicals, we prepared a detailed legal submission requesting a health waiver.
